การศึกษาเปรียบเทียบคัมภีร์พระมนูธรรมศาสตร์ฉบับภาษาสันสกฤตกับฉบับภาษามอญ

Abstract

การวิจัยครั้งนี้มีจุดมุ่งหมายเพื่อศึกษาเปรียบเทียบคัมภีร์พระมนูธรรมศาสตร์ฉบับภาษาสันสกฤตกับฉบับภาษามอญในด้านความเป็นมา โครงสร้าง การจัดประเภทและแบ่งหมวดหมู่เนื้อหา และเนื้อหาบทบัญญัติ ตามลักษณะกฎหมายโบราณ และเพื่อศึกษาเปรียบเทียบลักษณะและหลักการของระบบกฎหมายฮินดูและระบบกฎหมายพุทธ โดยมีสมมุติฐานว่า ระบบกฎหมายฮินดูและกฎหมายพุทธมีลักษณะและหลักเกณฑ์ของกฎหมายแตกต่างกัน และระบบกฎหมายพุทธเป็นการนำเอาระบบกฎหมายของฮินดูมาดัดแปลงโดยคงลักษณะที่ใช้ร่วมกันได้และแก้ไขลักษณะที่ขัดกับความเชื่อตามหลักการของศาสนาพุทธ การศึกษาคัมภีร์ทั้งสองจะจำกัดเฉพาะการวิเคราะห์ในด้านกฎหมายโบราณและปรัชญาศาสนาเท่านั้น ผลการศึกษาพบว่า คัมภีร์ทั้งสองมีความแตกต่างกันทั้งในด้านความเป็นมา โครงสร้าง การจัดประเภท และการแบ่งหมวดหมู่เนื้อหา แต่เนื้อหาบทบัญญัติบางส่วนคล้ายคลึงกัน และสรุปได้ว่าระบบกฎหมายฮินดูและระบบกฎหมายพุทธมีลักษณะและหลักเกณฑ์แตกต่างกัน และระบบกฎหมายพุทธเป็นการนำเอาระบบกฎหมายฮินดูมาดัดแปลงโดยคงลักษณะที่ใช้ร่วมกันได้และแก้ไขลักษณะที่ขัดกับความเชื่อตามหลักการของศาสนาพุทธตามที่ได้ตั้งสมมุติฐานเอาไว้

The objective of this research was to compare the Sanskrit version and Mon versions of the Manu Dharmasastra from the point of view of history, structure, classification of the content, and the ordinance according to the ancient law. The comparison was also made with regard to the characteristics and principles of Hindu law and Buddhistic law on the hypothetical basis that the Hindu law and Buddhistic law have different characteristics and principles, and that the Buddhistic law adopted the Hindu law by maintaining the common characters that can be accepted. But those that can not be accepted from the point of view of Buddhism were changed. The study of both versions was restricted to the analysis of the texts from the legal, religious and philosophical aspects. The result of the study was as follows : Both versions of the text differ from the point of view of history, structure, and classification of the contents, but the ordinances in part are similar. In conclusion, the system of Hindu law and that of the Buddhistic law have different characteristics and principles. The Buddhistic law adapted the Hindu law, maintaining only the character that was acceptable to Buddhism but changed those which were contrary to the Buddhistic principles.
